Giri\u015f<\/strong><\/h2>\n\n\n\n<p>Avrupa Birli\u011fi iltica hukukunda \u201cikinci iltica\u201d kavram\u0131, bir ki\u015finin iltica m\u00fcracaat\u0131 yapt\u0131\u011f\u0131 \u00fclkede <strong>ba\u015fvurusunun reddedilmesi neticesinde yeniden m\u00fcracaat yapabilmesi<\/strong> yada&nbsp; bir ki\u015finin <strong>\u00f6nceden uluslararas\u0131 koruma ba\u015fvurusunda bulunmu\u015f<\/strong> \u2014hatta bir \u00dcye Devlette <strong>m\u00fclteci veya ikincil koruma stat\u00fcs\u00fc alm\u0131\u015f<\/strong>\u2014 olmas\u0131na ra\u011fmen, <strong>ba\u015fka bir \u00dcye Devlette yeni bir s\u0131\u011f\u0131nma talebinde<\/strong> bulunmas\u0131 durumunu ifade eder.<br>&nbsp;<\/p>\n\n\n\n<p>Bu olgu, \u00f6zellikle <strong>Yunanistan veya \u0130talya\u2019da stat\u00fc ald\u0131ktan sonra Hollanda, Almanya veya Fransa\u2019da ikinci ba\u015fvuru yapan<\/strong> ki\u015filer bak\u0131m\u0131ndan g\u00fcn\u00fcm\u00fczde olduk\u00e7a yayg\u0131nd\u0131r.<\/p>\n\n\n\n<p>Uzun y\u0131llar boyunca bu t\u00fcr ba\u015fvurular, \u201c<strong>zaten ba\u015fka bir \u00fclkede koruma ald\u0131n\u0131z<\/strong>\u201d gerek\u00e7esiyle otomatik olarak reddedilmektedir. Ancak <strong>Avrupa Birli\u011fi Adalet Divan\u0131\u2019n\u0131n (ABAD) 18 Haziran 2024 tarihli <\/strong><strong><em>QY v. Bundesrepublik Deutschland<\/em><\/strong><strong> (C-753\/22)<\/strong> karar\u0131, bu uygulamay\u0131 k\u00f6kten de\u011fi\u015ftirmi\u015ftir.<\/p>\n\n\n\n<p>Bu makale, QY karar\u0131n\u0131n getirdi\u011fi yeni standartlar\u0131, \u201cikinci iltica\u201d ba\u015fvurular\u0131n\u0131n kabul edilebilirlik \u015fartlar\u0131n\u0131 ve ba\u015fvuran lehine geli\u015ftirilebilecek savunma stratejilerini analiz etmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. \u0130kinci \u0130ltica Kavram\u0131 ve Hukuki \u00c7er\u00e7evesi<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2.1. Tan\u0131m<\/strong><\/h3>\n\n\n\n<p>\u201c<strong>\u0130kinci iltica ba\u015fvurusu<\/strong>\u201d (<em>subsequent asylum application \/ opvolgende asielaanvraag<\/em>), bir ba\u015fvuran\u0131n:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ayn\u0131 \u00fclkede \u00f6nceki ba\u015fvurusu reddedildikten sonra <strong>yeniden ba\u015fvuru yapmas\u0131<\/strong> veya<br><\/li>\n\n\n\n<li>Ba\u015fka bir \u00dcye Devlette koruma stat\u00fcs\u00fc ald\u0131ktan sonra <strong>farkl\u0131 bir \u00fclkede ba\u015fvuru yapmas\u0131<\/strong> anlam\u0131na gelir.<br><\/li>\n<\/ul>\n\n\n\n<p>Bu ikinci durum, <strong>AB d\u00fczeyinde \u201csekonder hareketler\u201d (secondary movements)<\/strong> olarak adland\u0131r\u0131l\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2.2. Yasal Dayanak<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Dublin III T\u00fcz\u00fc\u011f\u00fc (No. 604\/2013)<\/strong> \u2013 sorumlu devletin belirlenmesi.<br><\/li>\n\n\n\n<li><strong>\u0130ltica Usulleri Direktifi (2013\/32\/EU)<\/strong> \u2013 sonraki ba\u015fvurular\u0131n incelenme \u015fartlar\u0131.<br><\/li>\n\n\n\n<li><strong>Vreemdelingenwet 2000 (m. 28 ve 4:6)<\/strong> \u2013 Hollanda uygulamas\u0131.<br><\/li>\n\n\n\n<li><strong>ABAD QY Karar\u0131 (C-753\/22)<\/strong> \u2013 \u00f6nceki stat\u00fcye ra\u011fmen yeni ba\u015fvurunun de\u011ferlendirilmesi gerekti\u011fini a\u00e7\u0131klar.<br><\/li>\n<\/ul>\n\n\n\n<p><strong>3. AYNI \u00dcLKEYE \u0130K\u0130NC\u0130 \u0130LT\u0130CA TALEB\u0130 (<\/strong><strong><em>opvolgende asielaanvraag)<\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.1. Tan\u0131m ve ko\u015fullar:<\/strong><\/h3>\n\n\n\n<p>Bu t\u00fcr ba\u015fvuruya AB ve Hollanda hukukunda \u201c <strong>opvolgende asielaanvraag<\/strong> \u201d (ard\u0131l\/ikinci iltica yat\u0131r\u0131m\u0131) denir.<\/p>\n\n\n\n<p><br>Bu ba\u015fvurunun kabul edilebilmesi i\u00e7in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Yeni olgular veya deliller<\/strong>&nbsp; ortaya \u00e7\u0131km\u0131\u015f olmal\u0131 (\u00f6rne\u011fin, yeni bir belge, yeni bir tehdit, yeni bir siyasi geli\u015fme vb.),<br><\/li>\n\n\n\n<li>Ya da <strong>belirgin bilinmeyen veya de\u011ferlendirilmemi\u015f<\/strong> ki\u015fisel riskler bulunmal\u0131d\u0131r.<br><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3.2. Uygulamada:<\/strong><\/h3>\n\n\n\n<p>E\u011fer ki\u015fi yeni ba\u015fvuruda \u201c\u00f6nceki gerek\u00e7elerin ayn\u0131s\u0131n\u0131\u201d tekrarlarsa, IND bu ba\u015fvuruyu \u201ckabul edilemez\u201d diyebilir.<br>Ancak ba\u015fvuruda <strong>yeni riskler<\/strong> , <strong>ko\u015fullarda de\u011fi\u015fim<\/strong> veya <strong>ki\u015fisel durumdaki de\u011fi\u015fiklikler<\/strong> varsa, yeni ba\u015fvuruda \u201cciddiye al\u0131nmak\u201d zorunludur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Farkl\u0131 bir \u00fclkede ikinci iltica ba\u015fvurusu (uluslararas\u0131 d\u00fczeyde)<\/strong><\/h2>\n\n\n\n<p>Bu durum, \u00f6rne\u011fin bir ki\u015finin:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Yunanistan\u2019da stat\u00fc al\u0131p Hollanda\u2019da yeniden ba\u015fvuruda bulunmas\u0131<\/strong>,<br><\/li>\n\n\n\n<li>Veya <strong>\u0130talya\u2019da reddedilip Almanya\u2019da tekrar s\u0131\u011f\u0131nma talep etmesi<\/strong><strong><br><\/strong> gibi halleri kapsar.<br><\/li>\n<\/ul>\n\n\n\n<p>Bu durumun hukuki dayana\u011f\u0131 ve de\u011ferlendirme y\u00f6ntemi, <strong>AB Dublin III T\u00fcz\u00fc\u011f\u00fc<\/strong> (604\/2013) ve <strong>ABAD (AB Adalet Divan\u0131)\u2019\u0131n QY karar\u0131 (C-753\/22)<\/strong> ile belirlenmi\u015ftir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4.1. Dublin sistemi \u00e7er\u00e7evesinde:<\/strong><\/h3>\n\n\n\n<p>Normalde Dublin T\u00fcz\u00fc\u011f\u00fc, <strong>ilk ba\u015fvurunun yap\u0131ld\u0131\u011f\u0131 \u00fclkeyi<\/strong> \u201csorumlu \u00fclke\u201d olarak kabul eder. Yani iltica sistemi, ba\u015fvuran\u0131n \u201cAB i\u00e7inde birden fazla ba\u015fvuru yapmas\u0131n\u0131\u201d engellemeye \u00e7al\u0131\u015f\u0131r.<br>Ancak:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>E\u011fer ilk \u00fclke <strong>yeterli koruma sa\u011flayam\u0131yorsa<\/strong> (\u00f6rne\u011fin, insanl\u0131k d\u0131\u015f\u0131 ko\u015fullar, bar\u0131nma yoklu\u011fu, zul\u00fcm riski),<br><\/li>\n\n\n\n<li>Veya ki\u015finin <strong>o \u00fclkede fiilen korunmad\u0131\u011f\u0131<\/strong> somut olarak g\u00f6sterilebiliyor ise, ikinci \u00fclke <strong>\u201cyeni\u201d bir ba\u015fvuruyu de\u011ferlendirmek ile y\u00fck\u00fcml\u00fc<\/strong> olabilir.<br><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4.2. QY karar\u0131 \u0131\u015f\u0131\u011f\u0131nda:<\/strong><\/h3>\n\n\n\n<p>ABAD, \u201cba\u015fka bir \u00fcye devlette koruma stat\u00fcs\u00fc al\u0131nm\u0131\u015f olmas\u0131\u201d durumunda dahi, yeni \u00fclkenin:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00d6nceki dosyay\u0131 incelemesi<\/strong>,<br><\/li>\n\n\n\n<li><strong>Ki\u015fisel risk de\u011ferlendirmesi yapmas\u0131<\/strong>,<br><\/li>\n\n\n\n<li>Ve \u201csadece \u00f6nce stat\u00fc ald\u0131n\u0131z\u201d diyerek ba\u015fvuruyu reddetmesi gerekti\u011fini belirtmi\u015ftir.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4.3. Bu yola hangi durumlarda ba\u015fvurulabilir?<\/strong><\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>\u00d6nceki \u00fclke koruma sa\u011flam\u0131yorsa:<\/strong><strong><br><\/strong>Stat\u00fc verilmi\u015f olsa bile, ki\u015fi fiilen korunam\u0131yor, bar\u0131nma, sa\u011fl\u0131k, g\u00fcvenlik gibi haklara eri\u015femiyorum (\u00f6rne\u011fin Yunanistan\u2019daki a\u015f\u0131r\u0131 kamp ko\u015fullar\u0131 veya g\u00fcvenlik riskleri v.b)<br><\/li>\n\n\n\n<li><strong>Yeni veya artan bireysel risk varsa:<\/strong><strong><br><\/strong>\u00d6rne\u011fin ki\u015fi daha sonra siyasi olarak g\u00f6r\u00fcn\u00fcr h\u00e2le gelmi\u015f, ailesi tutuklanm\u0131\u015f, yeni bir dava a\u00e7\u0131lm\u0131\u015f vb.<br><\/li>\n\n\n\n<li><strong>\u00d6nceki \u00fclkede AB standartlar\u0131n\u0131n alt\u0131nda sistemsel eksiklikler varsa:<\/strong><strong><br><\/strong>ABAD ve A\u0130HM i\u00e7tihad\u0131na g\u00f6re, \u201cgeri g\u00f6nderilece\u011fi \u00fclke\u201dde (\u00f6rne\u011fin Yunanistan, Macaristan gibi) sistemik eksiklikler (sa\u011fl\u0131k sistemi, g\u00fcvenlik riskleri, e\u011fitim sistemi v.b) varsa, Dublin devri yap\u0131lamaz.<br><\/li>\n\n\n\n<li><strong>\u00d6zel insani nedenler:<\/strong><strong><br><\/strong>Aile birle\u015fimi, sa\u011fl\u0131k durumu, re\u015fit olmayan \u00e7ocuklar\u0131n \u00e7\u0131kar\u0131 gibi \u00f6zel durumlar varsa bu haktan yararlanabilir.<br><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4.4 Sonu\u00e7 ve pratik \u00f6neriler<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201c\u0130kinci iltica\u201d <strong>otomatik olarak reddedilemez.<\/strong><strong><br><\/strong><\/li>\n\n\n\n<li>Ba\u015fvuran mutlaka:<br><strong>Yeni olgular<\/strong> veya <strong>ki\u015fisel riskler<\/strong> sunmal\u0131,<br><strong>\u00d6nceki \u00fclke ko\u015fullar\u0131n\u0131n yetersizli\u011fini<\/strong> somut delillerle g\u00f6stermelidir.<br><\/li>\n\n\n\n<li>\u0130dare (\u00f6rne\u011fin Hollanda\u2019da IND), <strong>\u00f6nceki \u00fclkenin dosyas\u0131n\u0131<\/strong> istemek, <strong>ABAD-QY standard\u0131na g\u00f6re<\/strong> incelemek ve gerek\u00e7eli bir karar vermek zorundad\u0131r.<br><\/li>\n\n\n\n<li>Aksi h\u00e2lde, karar <strong>yarg\u0131sal denetime tak\u0131l\u0131r<\/strong> ve iptal edilebilir (\u00f6rne\u011fin Rechtbank Oost-Brabant, NL24.9401, 09.10.2025 karar\u0131).<br><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. ABAD-QY Karar\u0131n\u0131n \u00d6zeti ve \u00d6nemi<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5.1. Karar\u0131n \u00d6zeti<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ba\u015fvuran (QY), Almanya\u2019da yeni bir ba\u015fvuruda bulunmu\u015ftu; ancak kendisine <strong>ba\u015fka bir \u00dcye Devlette uluslararas\u0131 koruma verilmi\u015f<\/strong> olmas\u0131 gerek\u00e7e g\u00f6sterilerek ba\u015fvurusu <strong>\u201cinadmissible\u201d (kabul edilemez)<\/strong> say\u0131lm\u0131\u015ft\u0131.<br><\/li>\n\n\n\n<li>ABAD, bu uygulaman\u0131n <strong>AB hukuku ile ba\u011fda\u015fmad\u0131\u011f\u0131na<\/strong> karar verdi.<br><\/li>\n\n\n\n<li>Mahkemeye g\u00f6re, bir \u00dcye Devlette al\u0131nm\u0131\u015f koruma karar\u0131, di\u011fer bir \u00dcye Devletin <strong>otomatik olarak incelemeyi reddetmesi i\u00e7in yeterli de\u011fildir.<\/strong><strong><br><\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5.2. Karar\u0131n Temel \u0130lkeleri<\/strong><\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>\u00d6nceki stat\u00fc otomatik ret gerek\u00e7esi olamaz.<\/strong><strong><br><\/strong> Yetkili makamlar, ba\u015fvuran\u0131n \u00f6nceki \u00fclkesindeki dosyay\u0131 ve gerek\u00e7eli karar\u0131 <strong>tam olarak incelenmelidir.<\/strong><strong><br><\/strong><\/li>\n\n\n\n<li><strong>Ki\u015fisel risk yeniden de\u011ferlendirilmelidir.<\/strong><strong><br><\/strong> Ba\u015fvuran\u0131n \u00fclkesiyle ba\u011flant\u0131s\u0131, yeni olaylar, de\u011fi\u015fen ko\u015fullar, atfedilme riski gibi unsurlar dikkate al\u0131nmal\u0131d\u0131r.<br><\/li>\n\n\n\n<li><strong>Etkili ba\u015fvuru hakk\u0131 korunmal\u0131d\u0131r.<\/strong><strong><br><\/strong> Ba\u015fvuran, yeni risk veya olgular\u0131n\u0131 a\u00e7\u0131klama ve belgelendirme f\u0131rsat\u0131na sahip olmal\u0131d\u0131r.<br><\/li>\n\n\n\n<li><strong>\u0130darenin \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc geni\u015fledi.<\/strong><strong><br><\/strong> Ba\u015fvuru dosyalar\u0131n\u0131n ba\u015fka bir \u00fclkeden temin edilmesi, belgelerin \u00e7evrilmesi ve ba\u015fvuranlara m\u00fclakat yap\u0131lmas\u0131 zorunludur.<br><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. \u0130kinci \u0130ltica Ba\u015fvurular\u0131n\u0131n Kabul \u015eartlar\u0131<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>6.1. Kabul Edilebilirlik<\/strong><\/h3>\n\n\n\n<p>Bir ikinci ba\u015fvurunun kabul edilebilmesi i\u00e7in genellikle \u015fu ko\u015fullardan biri aran\u0131r:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Yeni olgular veya deliller <\/strong>&nbsp;ortaya \u00e7\u0131kmas\u0131.<br><\/li>\n\n\n\n<li><strong>Men\u015fei \u00fclke ko\u015fullar\u0131nda de\u011fi\u015fiklik<\/strong> (\u00f6rne\u011fin T\u00fcrkiye\u2019de bask\u0131lar\u0131n artmas\u0131).<br><\/li>\n\n\n\n<li><strong>\u00d6nceki \u00fclkede koruman\u0131n fiilen yetersiz olmas\u0131<\/strong> (\u00f6rne\u011fin Yunanistan\u2019da bar\u0131nma veya sa\u011fl\u0131k hizmetlerine eri\u015fimin yeterli olmamas\u0131)<br><\/li>\n\n\n\n<li><strong>Yeni bireysel riskin do\u011fmas\u0131<\/strong> (\u00f6rne\u011fin ki\u015finin yurt d\u0131\u015f\u0131nda daha g\u00f6r\u00fcn\u00fcr h\u00e2le gelmesi).<br><\/li>\n\n\n\n<li><strong>\u0130nsani nedenler<\/strong> \u2013 sa\u011fl\u0131k, aile birle\u015fimi, \u00e7ocuklar\u0131n y\u00fcksek yarar\u0131.<br><\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>6.2. QY Karar\u0131n\u0131n Kabul \u015eartlar\u0131na Etkisi<\/strong><\/h3>\n\n\n\n<p>QY karar\u0131, \u00f6zellikle 3. ve 4. ko\u015fullar a\u00e7\u0131s\u0131ndan d\u00f6n\u00fcm noktas\u0131d\u0131r.<br>Mahkeme, \u00f6nceki \u00fclkenin \u201ck\u00e2\u011f\u0131t \u00fczerinde koruma sa\u011flamas\u0131\u201dn\u0131n yeterli olmad\u0131\u011f\u0131n\u0131; koruman\u0131n <strong>fiilen etkin olup olmad\u0131\u011f\u0131n\u0131n<\/strong> ara\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fini belirtmi\u015ftir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. Savunma Stratejileri<\/strong><\/h2>\n\n\n\n<p>\u0130kinci iltica ba\u015fvurular\u0131nda ba\u015fvurucunun dikkat etmesi gereken stratejik ad\u0131mlar:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7.1. \u00d6nceki Dosyan\u0131n \u0130ncelenmesini Talep Etmek<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>IND\u2019den, ba\u015fvuran\u0131n \u00f6nceki \u00fclkesindeki (\u00f6rne\u011fin Yunanistan) dosyas\u0131n\u0131 talep etmesini isteyin.<br><\/li>\n\n\n\n<li>Dosya incelenmeden verilen karar, QY standard\u0131na g\u00f6re \u201c\u00f6zensiz\u201d say\u0131l\u0131r ve iptal edilir.<br><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7.2. Ki\u015fisel Riskin Somutla\u015ft\u0131r\u0131lmas\u0131<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Aile ge\u00e7mi\u015fi, siyasi ba\u011flant\u0131lar, sosyal medya payla\u015f\u0131mlar\u0131, pasaport veya askerlik bilgileri gibi unsurlar\u0131 bir arada sunun.<br><\/li>\n\n\n\n<li>\u00d6zellikle \u201c<strong>atfedilen aidiyet<\/strong>\u201d (\u00f6rne\u011fin G\u00fclen hareketine atfedilme) durumlar\u0131nda bireysel delil g\u00f6stermek \u00f6nemlidir.<br><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7.3. Belgelerin Usul\u00fcne Uygun Sunulmas\u0131<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>T\u00fcrk\u00e7e belgeleri yeminli terc\u00fcme ettirin.<br><\/li>\n\n\n\n<li>IND belge hakk\u0131nda yorum yapmadan \u00f6nce \u00e7eviri talep etmemi\u015fse, bu durum savunmada \u201cusul hatas\u0131\u201d olarak kullan\u0131labilir.<br><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7.4.
